There are fears that the ruling All Progressives Congress’s presidential candidate, Bola Tinubu, will be disqualified. This follows the recent decision of a Federal High Court in Abuja to overturn Governor Isiaka Oyetola’s nomination. According to the ruling, Governor Mai Mala Buni violated Section 183 of the Constitution by submitting their names to INEC.
In a stunning turn of events, the All Progressives Congress (APC) presidential candidate, Bola Ahmed Tinubu, may be disqualified if the courts uphold the decision of a Federal High Court sitting in Abuja that nullified the nomination of Governor Isiaka Oyetola and his deputy governorship candidate, Benedict Alabi, for the 2022 Osun state governorship election. According to Justice Emeka Nwite’s decision, Governor Mai Mala Buni and those who submitted their names to INEC violated Section 183 of the Federal Republic of Nigeria’s Constitution and Section 82(3) of the Electoral Act 2022.
The court ruled that Governor Mai Mala Buni violated Section 183 of the Constitution by holding dual executive positions as Governor of Yobe State and Chairman of the APC’s National Caretaker Committee. Section 183 states, in part, that
“The Governor, shall not, during the period he holds office, holds any other executive office or paid employment in any capacity whatsoever.”
This means that all of Buni’s actions as APC acting boss are null and void.
