Commercial Bus Driver Assaults Judge in Lagos

A magistrate court sitting in Lagos Island this Monday  heard a case of assault against a judge of the Lagos High Court, Honourable Justice Adeniyi Adebajo.

The defendant Quadri Kasali allegedly attacked Justice Adebajo on the 1st March, 2012 at about 11:20a.m.

 

Quadri hit the  Judge’s car as he  drove his vehicle on Moloney Street, Lagos Island.

 

The charge sheet read that he hit the judge, causing grievous harm  in a deliberate manner with intent to kill Honourable Justice Adeniyi Adebajo.

 

Kasali who was represented in court by lawyers from the chambers of Falana and Falana has pleaded not guilty to the offence.

 

The prosecuting lawyer, representing the Lagos Commissioner of Police asked the presiding Magistrate to continue remanding the defendant in prison, pending the advice of the Director of Public Prosecution (DPP).

 

Counsel  to Kasali objected to the application insisting that by virtue of Section 36 (5) of the Constitution and Section 115 of the Criminal Procedure Laws of Lagos, his client’s right to liberty is being breached especially as his presumption of innocence is still intact.

 

The Magistrate however turned down the request to admit Kasali to bail and instead ordered that he should further remanded for one month from today to obtain the DPP’s advice.

 

She consequently adjourned further proceedings till the 13th of August 2012.
