On Friday, Justice Abdul-aziz Anka declared null and void the APC election held on May 26, 2022, and thus annulled Binani’s purported victory as the election winner.
Binani received 430 votes during the primary election, defeating her closest competitor, Nuhu Ribadu, who received 280 votes, according to SaharaReporters on May 27, 2022.
Justice Anka ruled that Section 51 (1–4) of the Electoral Act was violated because there was ‘overvoting’ during the declaration of the results of the APC governorship primary election in Adamawa state on May 27, 2022.
He claimed that 50 delegates from Lamurde Local Government Area who should not have been allowed to vote in the primary election were. He claimed that there was no proof that the party held a Special Adhoc Delegates election there.
Ribadu had challenged Binani’s election in a suit filed on June 9, 2022, claiming that 1,009 delegates were accredited, despite the fact that a total of 1,011 votes were cast.
As a result, the former anti-corruption chief requested that the election be declared null and void and a new governorship primary be held.
“It is in our nation’s interest that political parties follow internal democracy rules,” Justice Anka said, quoting a Supreme Court decision.
As a result, he declared that the APC will not run a candidate in the 2023 election.
